This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you visit www.5thhousefarms.com, contact us, subscribe to communications, or use website features.

This Privacy Policy is a notice of our practices. It is not a contract and does not create rights beyond those provided by applicable law or expressly stated here.

1. Age Restriction

Web3Forms may also process technical metadata associated with a submission, including an Internet Protocol address, submission date and time, and referring page information.

Web3Forms uses infrastructure and service providers to receive, secure, screen, store, and forward submissions. Its published subprocessors include Amazon Web Services, Cloudflare, Hetzner, CleanTalk, and Akismet. CleanTalk or Akismet may receive a submitter’s Internet Protocol address and email address for spam and abuse prevention.

Do not submit medical records, diagnoses, treatment information, financial account information, government identification numbers, or other sensitive information through the contact form.

Submitting a contact form does not establish a patient, medical, retail, contractual, or professional advisory relationship with 5th House Farms.

5. Retailer Finder and Location Information

The retailer finder allows visitors to search by retailer name, city, ZIP code, or location.

If you enter a location, the search information may be transmitted to LocationIQ to identify geographic coordinates and nearby retailers. Map information may also be provided through LocationIQ, OpenStreetMap, Leaflet, or related mapping services.

If you select a device location feature, your browser or device will ask whether you want to share your location. We do not receive the device location through that feature unless you grant permission. You may deny or withdraw location permission through your browser or device settings.

Location search results may be stored temporarily in your browser to improve performance and reduce repeated requests. Retailer listings, inventory, hours, availability, and external website information are controlled by the applicable retailer and may change without notice.

When you follow an external link, the privacy policy and terms of the external website apply. A link from 5th House Farms does not mean that we operate or control the linked website.

10. Sale, Sharing, Analytics, and Advertising

5th House Farms does not sell personal information for money.

We disclose personal information to service providers that help us operate the website and conduct our business. These providers may include hosting companies, Web3Forms and its subprocessors, mapping services, analytics providers, online marketing platforms, Constant Contact, and technical support providers.

We may use Google Analytics, Google Ads, Meta Pixel, TikTok Pixel, or similar technologies to measure website traffic, understand use of the website, evaluate marketing performance, and improve communications. These tools may collect Internet Protocol address, device and browser information, approximate location, referring website, pages viewed, advertising identifiers, and interactions with website features.

Information submitted through a contact form may be shared with authorized 5th House Farms personnel and sales representatives when necessary to respond to an inquiry, provide requested information, or follow up on a retailer or business request. We may also disclose information to an online marketing platform that manages communications and evaluates engagement on our behalf.

We do not provide contact information to affiliated brands, retailers, distributors, event partners, data brokers, or other sales partners for their independent marketing.

Marketing and Advertising Choices

You may opt out of promotional email by selecting the unsubscribe link in a marketing email or emailing info@5thhousefarms.com. An email opt out does not disable analytics cookies, pixels, or advertising technologies.

You may limit cookies and similar technologies through browser settings and any cookie preference controls provided on the website. Where required by applicable law, we will provide a method to withdraw consent or opt out of covered advertising or information sharing.

11. Information Retention

We retain personal information only as long as reasonably necessary for the purpose for which it was collected, including responding to inquiries, managing sales and retailer relationships, providing requested communications, operating and securing the website, meeting legal and regulatory obligations, resolving disputes, and enforcing agreements.

Contact submissions, inquiry emails, retailer and stocking requests, and sales prospect information are retained while an inquiry or business relationship remains active and for a reasonable period afterward for follow up and recordkeeping. Website server logs, location searches, and technical or security information are retained only as long as reasonably necessary to operate, troubleshoot, and protect the website, unless a longer period is needed to investigate misuse or meet legal obligations.

Age confirmation and retailer search information stored in a visitor’s browser remain on the device until they expire, are overwritten, or are deleted through browser settings.

Information submitted through Web3Forms may be retained by Web3Forms for up to three years from the submission date unless a shorter period applies to the 5th House Farms plan or the submission is deleted earlier. Dashboard availability may vary by plan. Following termination of the service, deletion may take up to 90 days and remain subject to routine backup cycles.

Copies forwarded to 5th House Farms by email or transferred to another business system are retained under our retention practices. Deleting a submission from Web3Forms will not necessarily delete copies previously delivered to email, a spreadsheet, a sales system, or another integration.

We may retain legal, accounting, tax, regulatory, licensing, and compliance records for the periods required by law or reasonably necessary to establish, exercise, or defend legal rights. When information is no longer needed, we or the applicable provider may delete or anonymize it where reasonably practical.

You may request deletion by emailing info@5thhousefarms.com. We may retain information when permitted or required by law, needed for legitimate business records, or necessary to establish, exercise, or defend legal rights. We may retain a limited record of an opt out request to continue honoring the preference.

12. Information Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, use, alteration, loss, or disclosure.

Web3Forms receives and processes information submitted through website forms. According to Web3Forms, submissions are transmitted using HTTPS and stored using encryption at rest. Web3Forms also describes access controls, spam screening, rate limiting, and other security measures used to provide its service.

No method of internet transmission or electronic storage is completely secure. We cannot guarantee the absolute security of information submitted through the website.

13. Consumer Health Data

5th House Farms does not use website information to diagnose a condition, recommend treatment, determine whether a product is medically appropriate, or intentionally create a profile concerning a visitor’s health.

You may ask us to review, correct, or delete personal information that you submitted directly to us. We will consider and respond to the request in accordance with applicable law and our legitimate recordkeeping, security, regulatory, and legal obligations.

Residents of certain jurisdictions may have additional rights under applicable privacy law. These rights vary based on the person’s location, the type of information involved, and whether the law applies to 5th House Farms.

Washington consumers have specific rights concerning consumer health data covered by the Washington My Health My Data Act. These may include confirming whether covered health data is collected, shared, or sold; accessing covered data and certain recipient information; withdrawing consent; requesting deletion; and appealing a refusal to act.

Submit a privacy request by emailing info@5thhousefarms.com with “Privacy Request” in the subject line. Describe the information and action requested. We may request information reasonably necessary to authenticate your identity and locate the relevant records. An authorized representative may submit a request when permitted by law, subject to verification of the authorization and requester.

We will respond within the period required by applicable law. If a request concerning covered consumer health data is denied, an appeal may be submitted to the same email address with “Privacy Request Appeal” in the subject line. If an appeal is denied, we will provide information about contacting the Washington Attorney General when required by law.

15. Email Communications

If you email us or submit a contact form, we may respond using the email address you provide. A response to an inquiry is a service or business communication.

Promotional and Marketing Email

5th House Farms may send newsletters, product announcements, retailer updates, event information, and other promotional email to people who have affirmatively consented to receive these communications.

Submitting a general contact form, product question, retailer inquiry, or stocking request does not automatically subscribe a person to promotional email unless the form clearly presents a marketing consent option and the person selects it.

Email Platform

5th House Farms uses Constant Contact to manage and deliver promotional email. Constant Contact may receive recipients’ names, email addresses, preferences, device information, and engagement information as needed to provide these services.

Unsubscribing

Recipients may unsubscribe by selecting the unsubscribe link included in a promotional email or emailing info@5thhousefarms.com. Requests will be processed promptly and within the period required by applicable law. We may retain the email address on a suppression list so the preference continues to be honored. After unsubscribing, a person may still receive responses to inquiries and other nonpromotional communications related to an active business matter.

Retailer and Business Communications

We may communicate with retailers, distributors, sales prospects, suppliers, event operators, and other business contacts about products, availability, orders, meetings, events, and business opportunities. Consumer and business promotional communications are managed through Constant Contact and use the same unsubscribe process.

Email Engagement Information

Constant Contact may track delivery, opens, link selections, delivery failures, device information, and similar engagement activity. We may use this information to evaluate communications, improve content, address delivery problems, and maintain mailing lists.

Sharing Email Addresses

We do not sell email addresses or provide them to affiliated brands, retailers, distributors, event partners, or other sales partners for their own marketing. Constant Contact and authorized personnel or sales representatives may process email addresses to manage 5th House Farms communications and legitimate business relationships.

Text Messages

5th House Farms does not currently operate a promotional or automated text messaging program. Providing a telephone number through the website does not constitute consent to receive marketing text messages. We may use a telephone number to respond to an inquiry or communicate about a specific business matter when requested or reasonably expected.

16. Business Transfers

Its spam prevention providers may process limited submission information in the United States or through global infrastructure. Constant Contact, analytics providers, hosting providers, and other service providers may also process information in locations where they or their approved providers operate.

The website is not specifically directed to or marketed toward consumers in Canada, the European Union, the United Kingdom, or other jurisdictions outside the United States. Accessing the website from another jurisdiction does not, by itself, indicate that 5th House Farms intends to conduct consumer business there.
