These Terms and disputes arising from the website will be governed by the laws of the State of Washington, without regard to conflict of law principles, except where applicable law requires otherwise.

Informal resolution

Before filing a legal action concerning the website or these Terms, you and 5th House Farms are encouraged, but not required, to make a reasonable, good faith effort to resolve the matter informally. Send a description of the dispute, relevant facts, contact information, and requested resolution to info@5thhousefarms.com with “Notice of Dispute” in the subject line. The parties should allow up to 30 days after receipt to attempt resolution.

This voluntary process does not prevent either party from seeking immediate relief, contacting a government agency, or filing before a legal deadline expires.

No mandatory arbitration, class action waiver, or jury trial waiver

These Terms do not require mandatory arbitration. Arbitration may be used only if both parties voluntarily agree in a separate writing after a dispute arises. These Terms do not require claims to be brought only individually, prohibit participation in a class or representative proceeding when permitted by law, or waive a jury trial right otherwise available under law.

Courts and venue

Subject to applicable law and court jurisdiction, proceedings may be brought in Washington state courts located in Thurston County or the United States District Court for the Western District of Washington. To the extent permitted by law, each party consents to the personal jurisdiction of those courts. Either party may bring an eligible claim in small claims court or seek immediate injunctive or equitable relief from a court with appropriate jurisdiction.

Fees, existing claims, and nonwaivable rights

Unless applicable law, a court order, or a separate written agreement provides otherwise, each party is responsible for its own attorney fees and costs. This section does not eliminate a nonwaivable right or remedy, restrict agency communications, or alter an applicable limitation period. It applies to disputes arising on or after the effective date and does not alter rights or claims accrued earlier.

If a provision is found invalid or unenforceable, it will be modified only to the extent necessary to make it enforceable or, if modification is not possible, severed. The remaining provisions will continue in effect.

A failure by 5th House Farms to enforce a provision does not waive its right to enforce that or another provision later.

You may not assign or transfer your rights or obligations under these Terms without written permission. 5th House Farms may assign its rights and obligations as part of a merger, acquisition, reorganization, asset transfer, or similar transaction, subject to applicable law.

These Terms and the Privacy Policy constitute the entire agreement concerning use of the website and replace prior website terms concerning the same subject.

We may update these Terms as the website, business practices, or law changes. Revised Terms will be posted with an updated effective date and apply prospectively from that date. When a change materially affects visitor rights or obligations, we will provide notice through the website or another reasonable method. Continued use after the revised effective date constitutes acknowledgment of the revised Terms.
